1. Agreement to these Terms

These Terms of Service govern access to and use of SHOPKWK.com, including the website, online store, customer-account area, product pages, pre-order hubs, checkout, blog content, contact forms, and related services (collectively, the “Site”).

By accessing the Site, creating a customer account, submitting an order, placing a pre-order, submitting information through a form, or otherwise using the Site, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Site or place an order.

These Terms apply together with the Site’s Privacy Policy, Shipping Policy, and Refund Policy. If there is a conflict, the specific policy or order term that directly addresses the subject will control to the extent permitted by applicable law.

2. About SHOPKWK

SHOPKWK is the official online store associated with KWK Brand. The Site offers wrestling-related collectibles, figures, merchandise, pre-order products, and related brand content.

The Site also provides information about KWK Brand’s talent-management and wrestling-related activities. References to talent, events, partners, distribution hubs, or future product lines are informational and do not create a separate representation, booking, sponsorship, or agency agreement unless confirmed in a separate written agreement.

Legal business name: KWK Branding Company Ltd.

3. Eligibility and account registration

You may browse the Site without an account. Some features, including customer order history and account services, may require registration or login through the Site’s customer-account system.

When creating or using an account, you agree to:

  • provide information that is accurate, current, and complete;
  • keep your login credentials confidential;
  • promptly update information that changes;
  • use only your own account or an account you are authorized to use; and
  • notify SHOPKWK promptly if you believe your account has been accessed without authorization.

You are responsible for activity carried out through your account unless the activity resulted from SHOPKWK’s failure to use reasonable security measures. SHOPKWK may suspend or close an account where it reasonably believes there is fraud, abuse, unlawful activity, a security risk, or a breach of these Terms.

The current Privacy Policy states that the Site is not intended for individuals under 16. The business should confirm whether that age policy remains correct before this Terms document is published.

4. Product information and availability

SHOPKWK aims to keep product names, descriptions, images, prices, availability, and estimated release information accurate. Product images and colors may vary by screen, photography, production variation, or packaging update.

A product displayed on the Site may be unavailable, sold out, discontinued, limited, or subject to a quantity limit. SHOPKWK may correct obvious errors, update product information, limit quantities, or discontinue a product at any time before accepting an order, subject to applicable law.

A product listing, announcement, or pre-order notice is not a guarantee that a particular quantity will remain available or that a stated estimate will not change.

5. Pre-orders and regional hubs

The Site offers regional shopping and pre-order hubs, including the United States and United Kingdom hubs. The Site states that regional hubs may use bulk shipment and domestic fulfillment arrangements to reduce international shipping costs.

United States Pre-Order Hub

The Site currently describes the US Pre-Order Hub as follows:

  • orders may be shipped in bulk to the United States and then organized for domestic fulfillment;
  • import taxes are stated to be paid in advance for orders placed through that hub;
  • the Site advertises a flat $5 domestic shipping rate on combinations of pre-order items; and
  • delivery may be approximately four weeks later than orders fulfilled through US distribution partners because of bulk international shipping and domestic processing.

United Kingdom Headquarters

The Site currently describes the KWK UK Headquarters as serving England, Wales, Scotland, and Northern Ireland. It states that import taxes are paid in advance for orders placed through that hub and advertises a flat $7 USD shipping fee, described as approximately £5, on combinations of orders.

In-stock UK Headquarters items: In-stock items ordered through the KWK UK Headquarters are expected to ship within 72 hours after payment, subject to payment authorization, order verification, weekends, public holidays, carrier collection schedules, and other circumstances outside SHOPKWK’s reasonable control. This 72-hour dispatch expectation applies only to in-stock items fulfilled through the UK Headquarters; it does not apply to pre-order items.

Pre-order items: Pre-order items will be shipped when the items have completed production and are ready for fulfillment. Production and fulfillment timing may change. KWK Brand will provide updates about pre-order progress through its official social-media pages, including its Facebook and Instagram pages. Customers should review those channels for the latest production and fulfillment updates.

Pre-order production, arrival, customs processing, bulk shipment, and domestic fulfillment can affect delivery timing. Any date shown on a product page is an estimate unless the Site expressly identifies it as a guaranteed date. SHOPKWK will communicate material changes or cancellation options where required by applicable law.

Pre-order payments are non-refundable after the pre-order has been placed and during the pre-order process. This restriction is subject to any refund, cancellation, or other consumer rights that cannot legally be excluded or waived under applicable law.

6. Orders and acceptance

Placing an order or pre-order is an offer to purchase the selected products. After checkout, the Site may send an order confirmation acknowledging receipt of the order. An order is accepted only when SHOPKWK confirms acceptance or begins fulfillment, unless applicable law provides otherwise.

SHOPKWK may refuse, cancel, or limit an order when permitted by law, including where:

  • a product or price was listed in error;
  • inventory or production capacity is unavailable;
  • payment cannot be authorized or completed;
  • an order appears fraudulent, abusive, or intended for unauthorized resale;
  • a shipping address or destination cannot be served; or
  • a legal, safety, customs, sanctions, or operational restriction applies.

If SHOPKWK cancels an accepted order, it will provide any refund required by applicable law and the applicable Refund Policy.

7. Prices, payment, taxes, and customs

Prices are displayed in USD unless the Site states otherwise. The Site may display discounts, sale prices, bundles, promotional prices, or regional shipping charges. Prices and promotions may change before an order is accepted.

You authorize the payment method used at checkout to be charged for the order total shown at checkout, including applicable product prices, shipping charges, taxes, duties, and other amounts disclosed before payment where applicable.

The Site’s regional-hub descriptions state that import taxes are paid in advance for those hubs. This does not automatically apply to every product, country, destination, or shipping method. You are responsible for reviewing the checkout total and any customs or tax information shown for your order.

SHOPKWK does not receive or store complete payment-card numbers where payment processing is handled by a third-party payment provider. Payment processing remains subject to the provider’s terms and privacy practices.

8. Shipping and delivery

Shipping and delivery are governed by the Shipping Policy displayed on the Site and the fulfillment terms for the relevant product and regional hub.

The 72-hour dispatch expectation applies only to in-stock items fulfilled through the KWK UK Headquarters, as described in Section 5. It does not apply to pre-order items, which will be shipped when production is complete and the items are ready for fulfillment.

For pre-order progress and production updates, customers should monitor KWK Brand’s official Facebook and Instagram pages. Shipping charges and services may change over time. Delivery estimates are not guarantees unless expressly stated otherwise.

You are responsible for providing a complete and accurate shipping address and contact information. If an address is incorrect, incomplete, inaccessible, or cannot accept delivery, additional charges, delay, return, or cancellation may result.

Risk of loss and responsibility for the product transfer as provided by applicable law and the shipping arrangement used for the order. Customers should inspect shipments promptly and report damage, missing items, wrong items, or delivery problems using the contact details in Section 16.

9. Returns, refunds, exchanges, and damaged items

Returns and refunds are governed by the Refund Policy displayed on the Site. The current Refund Policy states that eligible ShopKWK exclusive items may be returned within 30 days after receipt, subject to the conditions described there.

SHOPKWK does not offer second-hand items. The return terms below apply to eligible new ShopKWK products and remain subject to the product listing, the Refund Policy, and applicable law.

Pre-order payments are non-refundable after the pre-order has been placed and during the pre-order process. This restriction does not limit any refund, cancellation, or other consumer rights that cannot legally be excluded or waived under applicable law.

To request a return for an eligible non-pre-order product, contact SHOPKWK before sending anything back. Unauthorized returns may not be accepted. Returned products may need to be unused, unworn, complete, tagged, and in original packaging, with proof of purchase, subject to applicable law and the Refund Policy.

Customers should inspect orders on receipt and contact SHOPKWK promptly regarding defective, damaged, incomplete, or incorrect orders so the issue can be evaluated and resolved.

Nothing in these Terms limits non-waivable consumer rights under applicable law.

10. Customer order information and tracking

Customers may use the Site’s customer-account area to sign in, view order information, and access order details. Shipment tracking information is available when a carrier tracking number or fulfillment status has been supplied for the order.

Tracking information is provided by or through carriers and fulfillment partners. Carrier scans may be delayed, incomplete, estimated, or temporarily unavailable. A tracking page or status does not change SHOPKWK’s obligations under applicable law or the applicable Shipping and Refund Policies.

11. Website use and prohibited conduct

You may use the Site only for lawful purposes and in accordance with these Terms. You must not:

  • violate any applicable law, regulation, sanction, or third-party right;
  • use the Site to commit fraud, impersonate another person, or misrepresent an affiliation;
  • interfere with the Site, its servers, security, checkout, account system, or payment process;
  • introduce malware, malicious code, automated abuse, scraping tools, or unauthorized access methods;
  • attempt to bypass access controls, rate limits, account restrictions, or technical protections;
  • use product images, text, brand assets, or Site content for unauthorized commercial purposes;
  • submit false, defamatory, abusive, hateful, infringing, or unlawful material; or
  • use the Site to collect another person’s personal information without authorization.

SHOPKWK may investigate suspected misuse and may suspend access, cancel orders, remove submissions, or refer conduct to appropriate authorities where lawful and appropriate.

12. Intellectual property

The Site and its contents—including brand names, logos, artwork, photographs, product images, designs, text, graphics, layout, videos, and other materials—are owned by or licensed to KWK Brand, SHOPKWK, or the relevant rights holder and are protected by applicable intellectual-property laws.

You may view and use Site content for personal, non-commercial shopping and informational purposes. You may not copy, reproduce, distribute, modify, publish, sell, license, mirror, scrape, or create derivative works from Site content without prior written permission, except where applicable law permits it.

“KWK Brand,” “SHOPKWK,” product names, logos, and related marks may not be used in a way that implies sponsorship, endorsement, affiliation, or authorization without written permission.

13. Customer submissions and feedback

If you submit a review, comment, image, message, suggestion, idea, or other material through the Site or related channels, you represent that:

  • you own or have permission to submit it;
  • it does not violate another person’s rights;
  • it is not unlawful, deceptive, abusive, or malicious; and
  • it does not contain confidential information that should not be disclosed.

You grant SHOPKWK a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, display, adapt, translate, distribute, and use the submission for operating, promoting, and improving the Site and KWK Brand, subject to applicable law and the Privacy Policy.

SHOPKWK may moderate, remove, or decline to publish submissions, but does not promise to monitor all content.

14. Third-party services and links

The Site may include third-party payment providers, delivery carriers, social-media integrations, analytics, advertising services, external websites, or other third-party features. Third-party services are governed by their own terms and privacy policies.

SHOPKWK is not responsible for the availability, security, content, accuracy, or practices of third-party services that it does not control. A link or integration does not necessarily constitute an endorsement.

15. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as available” and “as is” basis. SHOPKWK does not guarantee that the Site will always be uninterrupted, error-free, secure, current, or free of harmful code, or that every product or feature will remain available.

To the maximum extent permitted by law, SHOPKWK will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of the Site, delay, inability to access the Site, third-party services, carrier events, or an order issue.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or non-waivable consumer rights.

This section remains subject to applicable mandatory legal protections and any non-waivable consumer rights.

For general support, order questions, returns, shipping questions, or privacy questions:

The Site’s Contact KWK Brand page states that contact-form responses are expected within 24–48 hours. That is a stated response target, not a guarantee.

17. Changes to these Terms

SHOPKWK may update these Terms from time to time to reflect operational, legal, product, service, or security changes. The revised Terms will be posted on the Site with an updated “Last updated” date. Changes apply from the stated effective date and do not retroactively alter rights that cannot lawfully be changed retroactively.

18. Suspension and termination

SHOPKWK may suspend or terminate access to the Site or a customer account if it reasonably believes that the customer has breached these Terms, engaged in fraud or abuse, created a security risk, or used the Site unlawfully.

You may stop using the Site at any time. Provisions that by their nature should continue after termination—including intellectual property, disclaimers, liability limits, dispute provisions, and payment obligations—will continue to the extent permitted by law.

19. Governing law and disputes

These Terms are governed by the laws of Hong Kong, PRC, without regard to conflict-of-law principles, subject to any mandatory consumer-protection or other applicable legal rights that cannot be excluded.

Any dispute arising from or relating to these Terms, the Site, or an order shall be submitted to the courts of Hong Kong, PRC, unless applicable law requires a different forum or gives the customer a mandatory right to bring a claim elsewhere.

20. Entire agreement and severability

These Terms, together with the policies and order-specific terms incorporated into them, form the agreement between you and SHOPKWK concerning use of the Site and purchase-related services, except where a separate written agreement applies.

If a provision is found invalid or unenforceable, it will be modified or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver of the right to enforce it later.
